Memorial Tree Planting Program Application

  1. Application for a Memorial Tree

    Thank you for your interest in planting a memorial tree on public property. Individuals who would like to plant a memorial tree on public property, including any park, must first submit a request to the Director of Public Works using this online application form.

    The Director of Public Works shall review all applications, and must approve the proposed tree selection, the planting location and the memorial plaque or stone. 

  2. Please provide a PDF or JPEG map or diagram of where on the public property you propose to plant the tree.

  3. Please provide the name of the contractor. Note a contractor must be licensed with the Building and Housing Department per Section 547 of the City’s ordinances.

  4. Will There Be a Memorial Plaque or Stone?*
  5. Please note that:

    • A memorial plaque shall be no larger than 12” x 12”. The plaque shall be fastened to a 4” x 4” treated post, no taller than 48” above the existing grade.
    • A memorial stone shall be limited to 18” x 18” , and shall be level with the existing grade.
  6. Terms

    Upon review of the application, the City Forester or the Director’s designee will issue a letter approving the planting of the memorial tree on public property. The Applicant will have 60 days to plant the tree after receiving approval. If Applicant needs more time, a request must be made to the Director for an extension of time.

    By sending the letter of approval to plant the tree, the City grants Applicant a non-exclusive, temporary License to plant a tree on the City property described in the Application. The term of this license shall be for a period beginning on the date of the receipt by Applicant of the City’s approval letter, and end 60 days thereafter, unless extended by the City.

    In consideration of the right to plant a tree on the City’s property, Applicant agrees to purchase, install (as per the City's standard installation drawing) and maintain the tree, and repair any damage to the City’s property or right-of-way caused during such activity, including watering. 

    Applicants or their contractor or agents must contact Ohio Utilities Protection Service (OUPS) at least 48 hours prior to planting the tree.

    It is the sole responsibility of the Applicant to stake, mulch and water the tree as needed. 

    The City of Shaker Heights assumes no responsibility for purchasing, planting, or maintaining the tree, or for replacing the tree if it fails.

    Applicant agrees to comply with all laws, rules, and regulations that are applicable to the City’s property and right-of way while installing the tree, repairing any damage or maintain the tree.

    Applicant, for himself/herself, and for his/her contractor and agent(s), agrees to protect, indemnify and save the City harmless from and against all liabilities, damages, losses, claims, actions, costs and expenses of any nature resulting from injuries or damages to persons or property on or about the City’s property or adjoining sidewalks or paved areas arising out of Applicant’s activity installing the tree, repairing any damage to City property or maintaining the tree.

    Applicant agrees that all property of Applicant and its contractor or agent(s) while on the City’s property shall be at the sole risk and hazard of Applicant, its contractor or agent(s). The City shall not be liable or responsible for any loss, injury or damage to Applicant, its contractor or agent(s) or any of their property unless caused by acts or omissions of the City.

  7. Electronic Signature Agreement*
